The ruling states that public health should not overlap with workplace policy.
The Fifth Circuit Court of Appeals blocked President Joe Biden’s COVID-19 vaccine mandate for government contractors. Judge Don Willet wrote the opinion of the majority, in which they stated that such a mandate is outside of the scope of the president’s statutory authority and that Congress must explicitly give him such executive power.
The Fifth Circuit Court, based in Louisiana, is the fourth federal appeals court to review appeals made to review President Biden’s government contractor vaccine mandate. Dozens of states have submitted appeals against it, arguing that such a mandate exercises too much power over issues that should be state-led. Government contractors make up nearly a quarter of the U.S. workforce, and President Biden’s mandate would have affected thousands of businesses in all 50 states.
